BlockReference.explode throws eCannotExplodeEntity

I can't explode the block references, but when I insert them into the modelspace I can do it from the UI. Is there a way to do this? This is an intermediate problem, I want to be able to scale a circle with a non-uniform scale, but it returns Db.ErrorStatus.eCannotScaleNonUniformly

in AutoCAD you can't explode non uniformly scaled references in the GUI or API

I guess some objects you can, a circle explodes into an ellipse, other objects fail
