17+ PREAMBLE:
18+ The accompanying software, firmware, documentation, and related
19+ materials ("Product") are the sole property of Total Phase, Inc.
20+ ("Total Phase"). Its use and distribution is subject to the
21+ terms in this License Agreement ("Agreement").

23+ By the use or distribution of the Product, you are consenting to
24+ be bound by the terms of this Agreement. If you do not agree, do
25+ not use or distribute the Product in whole or in part.

28+ TERMS OF USE:
29+ Permission to use, copy, modify, and distribute the Product
30+ is hereby granted, subject to the conditions stated below:

32+ a. The Product is licensed only for use with other Total Phase
33+ products. Any other use is permitted only with the express
34+ written permission of Total Phase.

36+ b. The Product may only be copied unmodified in its entirety,
37+ with all of the files intact including a verbatim copy of this
38+ Agreement. Distribution of modified copies is permitted only
39+ with the express written permission of Total Phase.

41+ c. The Product must not be placed on any publicly-accessible
42+ Internet server including, but not limited to, web servers, ftp
43+ servers, and file sharing systems. Instead, a link should be
44+ placed to the Total Phase website where the latest versions
45+ may be obtained.

47+ d. As a special exemption, a copy of the shared object file,
48+ aardvark.dll or aardvark.so ("Shared Object File"), may be
49+ distributed separately from the Product, provided that it is part
50+ of a separate work ("Separate Work"). Such Shared Object Files
51+ carry with them all of the rights and limitations outlined in
52+ this Agreement, except that it may not be further distributed
53+ unless part of the Separate Work.

55+ Before publicly distributing the Shared Object Files, whether
56+ gratis or for a fee, you must notify Total Phase by electronic
57+ mail to:

58+ Manager. Provide a description of the Separate Work, specifically
59+ mentioning how any Total Phase hardware and the Shared Object
60+ Files will be integrated into the Separate Work and your proposed
61+ method of distribution. Total Phase will acknowledge the

64+ You are required to include a copy of this Agreement with your
65+ Separate Work.

67+ e. Any separate works which include the Product must be plainly
68+ marked as such, and must not be misrepresented as the original
69+ software.

71+ f. You may not modify, translate, reverse-engineer, decompile,
72+ disassemble (except and solely to the extent that an applicable
73+ statute expressly and specifically prohibits such restrictions),
74+ or create derivative works of the Product. A separate work
75+ that only makes use of the unmodified shared object file is not
76+ considered a derivative work.

79+ PROPRIETARY RIGHTS:
80+ The Product is owned by Total Phase and is protected by United
81+ States copyright laws and international treaty provisions. All
82+ copyright, patent, trade secret, trademarks, and other intellectual
83+ and proprietary rights in the Product are and shall remain the
84+ valuable property of Total Phase. You agree to take all necessary
85+ steps to ensure that this property is protected and that the
86+ provisions of this Agreement are not violated by you or by any
87+ person under your control or in your service.

90+ TERMINATION:
91+ Your rights under this license will terminate automatically if you
92+ fail to comply with the terms and conditions set forth herein.

94+ If any provision of this license agreement is held to be
95+ unenforceable, that provision shall be reformed only to the extent
96+ necessary to make it enforceable; and the balance of this license
97+ agreement shall remain in full force and effect.

100+ SAFETY-CRITICAL SYSTEMS POLICY:
101+ The Product is not authorized for use in life support devices or
102+ systems. Life support devices or systems include, but are not
103+ limited to, surgical implants, medical systems, and other
104+ safety-critical systems in which failure of a Total Phase product
105+ could cause personal injury or loss of life.

107+ The Product is not fault-tolerant and is not designed, manufactured
108+ or intended for use or resale in hazardous environments requiring
109+ fail-safe performance, such as in the operation of nuclear facilities,
110+ aircraft navigation or communication systems, air traffic control,
111+ or weapons systems, in which the failure of the Product could lead
112+ directly to death, personal injury, or severe physical or environ-
113+ mental damage. Such use is unauthorized by Total Phase.

115+ Should the Product be used in any such unauthorized manner, Buyer
116+ agrees to indemnify and hold harmless Total Phase, its officers,
117+ employees, affiliates, and distributors from any and all claims
118+ arising from such use, even if such claim alleges that Total Phase
119+ was negligent in the design or manufacture of the Product.

122+ OPEN SOURCE:
123+ The software API portion of the Product makes use of open source
124+ libraries that are not owned by Total Phase and are licensed under
125+ different terms. For specific details, please see the documentation
126+ that is included with the software API package.

130+ THE PRODUCT IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND.

132+ WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT

141+ BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF
