ERROR duplicate key value, after attempt to recreate once existed custom field value

Steps to reproduce

1. Create a custom field "Story" for project
2. Have a tree using this custom field
3. Create manual test case via allure UI. Create new value for story "story 1". This test is going to be the only one using this value
4. Automate this test case without reporting "Story"
5. Report this test to allure

Actual result
"story 1" will be deleted from tree, as no more tests are using it. But when we try to create story with this name again - we are getting ERROR 409
