I was thinking about this but this should definitely throw an exception (such as the one thrown when the buffer has a syntax error). That way an in game tool (such as SMODS) can let you restart the game and also present the error more usefully

There are legitimate patches this can hurt, it is possible to have a patch which intentionally "deactivates" another patch by ensuring it never applies (by putting, say, a random comment where the patch-to-be-disabled would have matched on).

If a patch were to have this magic property set, it wouldn't be able to be disabled in such a way, and the alternatives for disabling the effects of patches (like placing an if false then before and an end after) are much more shakey.
