As it is written here [https://inspire-reference.jrc.ec.europa.eu/vocabularies/tasks/share-spatial-data-set/provide-and-operate-download-service/control-access-download-service-if-necessary](https://inspire-reference.jrc.ec.europa.eu/vocabularies/tasks/share-spatial-data-set/provide-and-operate-download-service/control-access-download-service-if-necessary) it is valid to place access protection on INSPIRE download services or, like in this case, the referenced datasets in an Atom Feed. For me that means the validator should also accept a 401 when testing the download of the data.
