SwiftWing Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SwiftWing ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Description of Service

SwiftWing is an iOS application that provides:

  • Camera-based book spine scanning
  • AI-powered book identification and metadata retrieval
  • Local library management and organization
  • Offline scanning queue with auto-upload

The app is provided free of charge with no in-app purchases or subscriptions.

3. User Responsibilities

You agree to:

  • Use the app only for personal, non-commercial purposes
  • Scan books you own or have permission to scan
  • Not attempt to reverse engineer, decompile, or hack the app
  • Not use the app to violate any applicable laws or regulations
  • Not abuse or overload our Talaria API backend

4. Camera and Privacy

By using SwiftWing, you acknowledge that:

  • The app requires camera access to scan book spines
  • Photos are sent to our Talaria AI backend for processing
  • Images are not stored after AI analysis completes
  • You can revoke camera access at any time in iOS Settings

5. AI-Generated Metadata

SwiftWing uses AI to identify books and retrieve metadata. You acknowledge that:

  • AI results may be inaccurate - Metadata (title, author, ISBN) is generated by AI and may contain errors
  • No guarantees of accuracy - We do not guarantee the correctness of scan results
  • User verification recommended - You should verify important information (e.g., ISBN for purchases)
  • Duplicate detection - The app attempts to prevent duplicate entries but may not catch all cases

6. Offline Mode and Data Queue

When offline:

  • Scans are queued locally on your device
  • Queued scans auto-upload when network connectivity returns
  • You can manually delete queued scans at any time
  • We are not responsible for lost queue data due to app deletion or device issues

7. Third-Party Services

SwiftWing integrates with our Talaria API (https://api.oooefam.net) for AI processing. By using the app, you agree to:

  • Send book spine images to Talaria for analysis
  • Receive metadata from Talaria via Server-Sent Events (SSE)
  • Accept that Talaria uptime is not guaranteed (the service may experience downtime)

Talaria Rate Limits:

  • SwiftWing implements rate limiting to prevent API abuse
  • If you exceed rate limits, scanning may be temporarily disabled
  • Rate limit cooldowns are displayed in-app

8. Intellectual Property

  • SwiftWing app: Copyright © 2026 OOOEfam.net. All rights reserved.
  • User content: You retain ownership of your book library data stored locally on your device
  • Book metadata: Retrieved from public databases and AI analysis; ownership varies by source
  • Cover images: Provided by third-party sources; SwiftWing does not claim ownership

9. Disclaimer of Warranties

SwiftWing is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Accuracy of AI-generated metadata
  • Uninterrupted or error-free operation
  • Compatibility with future iOS versions

10. Limitation of Liability

To the maximum extent permitted by law, OOOEfam.net and SwiftWing shall not be liable for:

  • Inaccurate book metadata or ISBN information
  • Lost or corrupted library data
  • Inability to access the Talaria API
  • Any indirect, incidental, or consequential damages

Maximum liability: In no event shall our total liability exceed the amount you paid for the app (currently: $0, as the app is free).

11. No User Accounts

SwiftWing does not require or support user accounts. All data is stored locally on your device. You are responsible for:

  • Backing up your device (via iCloud or iTunes)
  • Managing your local library data
  • Understanding that uninstalling the app deletes your library

12. Updates and Modifications

We reserve the right to:

  • Update the app with new features, bug fixes, or improvements
  • Modify or discontinue features at any time without notice
  • Change these Terms of Service (changes will be reflected by updating the "Last Updated" date)

Continued use of SwiftWing after updates or changes constitutes acceptance.

13. Termination

You may stop using SwiftWing at any time by:

  • Deleting the app from your device
  • Revoking camera permissions in iOS Settings

We reserve the right to:

  • Block your access to the Talaria API if you violate these Terms
  • Discontinue the app or Talaria service at any time

14. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

15. Age Requirements

SwiftWing does not knowingly collect data from children under 13. By using the app, you confirm you are:

  • At least 13 years old, or
  • Using the app with parental/guardian supervision

16. Open Source Components

SwiftWing may use open-source libraries. Licenses for these components are available in the app's source code repository.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and OOOEfam.net regarding SwiftWing.

By using SwiftWing, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
